How can I write of debt?

Every year, millions of people enter into credit agreements such as loans and hire purchase agreements. Under the terms of the Consumer Credit Act, these credit agreements must be written in a certain way, in order to be legally binding. If this is not the case, however, the agreement could be unfair and therefore unenforceable.

What this means is that if you have entered into one of these credit agreements and it is found to be unfair, then Credit Clear can help you to write off the debt.

How will I know if I am able to write off my debt?

In order to write off debt, you will need to have the following:

A minimum of £1000.00 balance outstanding on your credit agreement
At least 12 months payments left on your credit agreement

How to write off Debt in 5 easy steps

Our simple, 5 step process will enable you to discover whether or not you are able to write off debt:

Step 1 – Application – The first step in discovering whether or not you are eligible to write off your debt is to fill in an online application form.

Step 2 – Post - Once your application form has been completed it is emailed back to you, simply print out the forms, sign and post back to our office.

Step 3 – Audit – Once we have received your completed forms by post, we can begin the process of assessing whether or not you can write off debt. This involves writing to your credit provider to request copies of the original credit agreement. Once this is received by us, it is sent off to our solicitors for auditing. If this reveals sufficient grounds for challenging the credit agreement, then we will pursue the process of writing off your debt.

Step 4 – Solicitors – At this stage, your claim will be in the hands of a specialist solicitor, who is assigned to your case. They will send you several documents which you must complete and return. Once this has been done, the solicitor will keep you informed on the progress of your claim.

Step 5 – Settlement – The lender will be notified that they are in breach of the Consumer Credit Act. If they do not then reach a settlement, then your assigned solicitor will take your case to court on your behalf. Most cases which reach this stage are successful, meaning that your debt will be written off completely.
