How We Work

Step 1 – Apply

Complete the simple online eligibility test to check if your Credit Agreement qualifies for audit. If it does then you need to complete the application form and pay your audit fees online using your Credit or Debit Card or by sending a cheque made payable to Credit Clear UK Ltd to our office.

Step 2 – Completed Claim Forms are emailed directly to you

The completed paperwork is emailed direct to you. So there is NO COMPLICATED PAPERWORK to fill in. You simply print out the completed forms, sign where indicated and post back to our office. Included in the email pack will be a Welcome and Instruction Letter, our Terms and Conditions, Individual Claim Forms, Frequently Asked Questions and return post letter. So you will have all the information you require downloadable at the touch of a button.

Step 3 – Track your case online

You will have access to your own online account. As soon as your claim forms are received in our office you will be notified via email that we are in receipt. We will begin by writing to the lender to request copies of your original credit agreements that they are obliged to provide under the terms of the Consumer Credit Act.

Step 4 – Audit begins

Once received, they will be sent to our solicitors for auditing. The audit will take our solicitors approximately 72 hours to complete. Credit Clear UK will contact you with the results of the audit. The audit report will set out all of the breaches within your credit agreement and form the basis for litigation. If sufficient grounds for litigation are identified in your Credit Agreement if a further fee is payable to allocate your case to our solicitor. If there are no breaches identified you will automatically receive a 100% REFUND OF YOUR AUDIT FEES.

Step 5 – Solicitors / Court Process

Once your case has been allocated to a solicitor you will received the following correspondence:

  • Solicitors Terms of Business – Please sign and return to the solicitor
  • Letter of Authority – This gives the solicitor permission to contact the lender on your behalf
  • Conditional Fee Agreement – Please Sign and return to the solicitor

Once the documents are received the solicitors will progress with your claim. They will write to you with full instructions how they are going to proceed with your claim.

Step 6 – The Process

After notifying the lender that they are in breach of the Consumer Credit Act and following the correct procedures leading to litigation the solicitors will apply to the court for a hearing date. If the defendants do not settle prior to the court action the solicitors will represent you in court.

After court, the solicitors will notify you of the results. All indications are that this will be a SUCCESSFUL RESULT and that you will be entitled to have your DEBTS WRITTEN OFF with no further costs to pay.
